In 2018, when cryptocurrencies made their first explosion, 200 Bitcoins came to the wallet of a
South Korean user. The user, who was not very curious about its source, transferred this amount to other wallets and spent 3 BTC for his own needs.
The platform, which accidentally sent 200 BTC, which was $ 1.25 million at the time and now corresponds to $ 9.8 million, took action and filed a lawsuit. As a result of the lawsuit, the user was sentenced to 18 months in prison for embezzlement and breach of trust.
While the decision is being appealed, the Supreme Court signed a critical decision this week. The court ruled that the country's laws do not recognize
Bitcoin as an asset, so it cannot be the subject of charges such as breach of trust and embezzlement. Court also added to the notes that the relationship between the sender and the receiver is not clear enough to be the subject of embezzlement.
Plaintiff's lawyers and local experts believe the decision was made in haste, and that a complex case should be scrutinized. It is also thought that it can encourage people who accidentally enter digital currency to spend it quickly.
