The European Court of Justice, the EU's high-level court, headquartered in Luxembourg, concluded the Austrian consumer protection association's lawsuit against German carmaker Volkswagen as part of its emission manipulation.
The court decided that, under the EU law, a case should be filed in the place where the accused resides in principle, but that the legal process can be started where the damage occurs.
In the decision, which emphasized that Volkswagen company in Germany can file a lawsuit in Austria, it was stated that if the manufacturer in any EU member country illegally manipulates the emission values of its cars to the parties in another member country, it can be sued where the damage occurred.
