Decision Announced in Bank Of America's Case!
The Decision has been Announced in the case of Bank of America freezing the debit cards from which unemployment benefits are paid.
US District Judge Vince Chhabria banned Bank of America from freezing accounts for California unemployment benefits based solely on an automatic fraud filter. In that case, the bank will have to find a better solution when unemployed people say their benefits have been stolen.
The debit cards of thousands of unemployed people in California were frozen and a lawsuit was filed on the subject. An interim injunction was issued in the case in question. Bank of America has negotiated over thousands of claims it has designated as fraudulent in order to avoid freezing debit cards.
Brian Danitz, lawyer for the unemployed, used the following statements in his defense: “The court's decision provides important and immediate relief to hundreds of thousands of unemployed. The bank has to comply with the law by investigating these allegations and issuing temporary loans.”
The judge ordered the creation of new customer service hotlines to assist those affected by the fraud.

Bank spokesman Bill Halldin stated that Bank of America's number one goal is to always ensure that legitimate buyers have access to their assistance, and that they are committed to taking additional measures as soon as possible.
The injunction prohibits Bank of America from only looking at the results of the automated claim fraud filter to freeze accounts. The court order will prevent the bank from denying, closing or crediting creditors' accounts without a full investigation.
In the judgment signed by Judge Chhabria, “The hardship this measure poses to the defendant outweighs the benefits it brings to class members.The action is in the public interest. It is clear from the records that Bank of America is violating people's rights by not doing a good enough job of responding to this crisis."
