Ministry Has Published the Remote Work Regulation
The Ministry has published the remote work regulation. The Ministry of Family, Labor and Social Services has determined the principles of remote work.
The regulation of the
Ministry of Family, Labor and Social Services, which includes the principles regarding remote work, was announced in the Official Gazette today.
According to the regulation announced in the Official Gazette, the business relationship can be established directly with a remote work contract or the work contract of the employee who is currently working at the workplace can be converted into a remote work contract if the employee and the employer agree.
The request to
work remotely will be notified in writing. In the event that remote work will be applied in the whole or part of the workplace due to compelling reasons specified in the legislation, the request or approval of the worker will not be sought for the transition to remote work.
Employers will Provide the Required Material
Result of the evaluation of the request will be notified to the worker within 30 days, in the same manner as the request is made. It will be essential that the materials and work tools required for the production of goods and services of the remote worker are provided by the employer, unless otherwise agreed in the employment contract.
Time interval and duration of remote work will be specified in the employment contract. Working hours can be changed by the parties, provided that the limitations stipulated in the legislation are adhered to. Overtime work will be carried out at the written request of the employer, with the acceptance of the worker, in accordance with the provisions of the legislation.
Issues related to determining and meeting the necessary expenses directly related to the production of goods or services arising from the performance of the work will be specified in the employment contract.
Which Jobs Will Not Be Involved In Remote Work?
According to the regulation, working with hazardous chemicals and radioactive materials, processing of these substances or working with the wastes of these substances, working processes that involve the risk of exposure to biological factors will not be included to remote work.
It will be determined by the public institution and organization that is responsible for the unit, project, facility or service or which service will not be able to work remotely in the units, projects, facilities or services that have strategic importance in terms of national security and the works performed by the public institutions and organizations by purchasing services according to the relevant legislation.
Employers, taking into account the nature of the work done by the remote worker, will be obliged to inform, to provide the necessary training, to provide health surveillance and to take the necessary occupational safety measures related to the equipment they provide.
